1/ What is Vietnam no Criminal Record certificate?

The Vietnamese No Criminal Record Certificate (or also called Vietnam judicial record, or Vietnamese police check Certificate, or Vietnamese Police clearance certificate – Phieu Ly lich tu phap) (according to Clause 1, Article 2 of the Law on Judicial Records in 2009) is the paper issued by agencies managing judicial record databases (provincial-level Justice Departments or National Center for Judicial Records), in which the content proves:

• Individuals with or without criminal records, judgments or decisions of the Court during their stay in Vietnam
• Whether an individual is currently banned from holding a position in the enterprise or establishing or managing an enterprise declared bankrupt by the Court.

2/ In which cases Chinese Need Vietnamese No Criminal Record Certificate?

Chinese passport holders who resided in Vietnam may need a Vietnamese No Criminal Record Certificate to do the following purposes:

• Applying for Vietnam work permit for Chinese people
• Complete the visa or immigration procedures to Australia or Canada for Chinese people
• Complete the marriage procedure for Chinese people

3/ How many type of Vietnamese No Criminal Record Certificate for Chinese

According to the Law No. 28/2009/QH12 of June 17, 2009, on judicial records, there are 02 types of Vietnamese No Criminal Record Certificate for Chinese people: No. 1 and No. 2.

The Vietnamese No Criminal Record Certificate No. 1 for Chinese is used for:

Chinese citizens who resided or are currently residing in Vietnam and want to get a Criminal Record for professional purposes: apply for a new job, apply for a work permit, etc.

The Vietnamese No Criminal Record Certificate No. 2 for Chinese is used for:

Chinese citizens who want to apply for study abroad, getting married abroad, applying for a job in a foreign company, applying for citizenship, applying for immigration procedures for the third country, etc.

4/ Conditions for granting Vietnamese No Criminal Record Certificate to Chinese

According to the provisions of the Law on Judicial Records, the Vietnamese No Criminal Record Certificate (criminal record) is issued to the Chinese who:

• resided in Vietnam; or
• are currently residing in Vietnam.
• It means that they have/had temporary residence in Vietnam.

5/ Documents for applying for the Vietnamese no criminal record for Chinese

• Form requesting issuance of the Vietnamese No Criminal Record Certificate 03/2013/TT-LLTP in case of self-application or 04/2013/TT-LLTP in case of authorized application.
• Certified copy of passport and visa of the person requested to be issued a criminal record;
• Certified copy of temporary residence registration certificate.

In case of authorization, the following papers are required:

• Original authorization document in accordance with the law (which is notarized, authenticated in accordance with the law)
• Identity card (or passport) of the authorized person.
• In case the applicant for a criminal record is a parent, spouse and child of the person who is issued with a Vietnamese No Criminal Record Certificate, no power of attorney is required but it is replaced by papers to prove the relationship (birth certificate; marriage certificate; etc.)

Note: The documents in the profile can be submitted without a certified copy, but it is necessary to bring the original for comparison.
